Rihanna won her battle against Topshop today when a London judge ruled in favor of the edgy singer. Rihanna sued Topshop for $5 million, accusing the British retailer of using her image from a video shoot on a tank without her permission and duping her fans into thinking she approved of the image.
Initially, the tanks were being sold as the “Rihanna Tank” but after she complained it was changed to “Headscarf Girl Tank” and then “Icon Tank.”
As reported by BBC News, here's what High Court Judge Justice Birrs said in a two-minute judgement:
The taking of the photograph is not suggested to have breached Rihanna's privacy. The mere sale by a trader of a T-shirt bearing an image of a famous person is not an act of passing off. However, I find that Topshop's sale of this T-shirt was an act of passing off.
